Brazilian Judge Threatens Bolsonaro with Imprisonment Over Social Media Speech Circulation

A Justice of Brazil’s Supreme Court has warned former president Jair Bolsonaro that he could face imprisonment, after a speech of his was shared by users online—despite an existing court-ordered ban on his use of social media. The stark warning was revealed in an official court document obtained by AFP on Monday.

The far-right former leader, who stands accused of plotting a “coup” against his successor, President Luiz Inácio Lula da Silva, made the controversial remarks during a public address on Monday. The speech rapidly gained traction on various social media platforms.

Who Shared the Speech?

Although Bolsonaro refrained from posting the content on his own accounts, the speech was widely disseminated by:

  • His sons
  • Political allies
  • Supporters on platforms including:
    • X (formerly Twitter)
    • Instagram
    • Facebook

Justice Alexandre de Moraes—who has frequently been at odds with Bolsonaro—highlighted the posts in court filings, displaying screenshots of accounts sharing videos, photos, and text extracts from the speech delivered in Congress.

According to Justice Moraes, Bolsonaro, aged 70, had “delivered a speech specifically intended for dissemination on digital platforms,” a move seen as a deliberate circumvention of the court-imposed restrictions.

Bolsonaro’s Legal Constraints

Bolsonaro is currently under judicial supervision, which includes:

Moraes has now issued a 24-hour deadline for Bolsonaro’s legal team to explain what he termed as a “breach of precautionary measures.” The justice further warned that failure to comply could result in the former president’s “immediate imprisonment.”

Warnings & Reactions

Earlier the same day, Moraes had made it clear in a separate ruling that any sharing of Bolsonaro’s speeches via social platforms would be seen as a violation of the restrictions. The warning extended to third-party shares as well, making the legal interpretation broad in scope.

Bolsonaro responded sharply, labelling the development as an act of “cowardice.”

Trump Enters the Fray

The controversy has drawn international attention, including from former U.S. President Donald Trump, a known ally of Bolsonaro. Trump condemned the legal actions as a “witch hunt” and announced retaliatory measures against Brazil unless the charges are dropped. These include:

  • Introduction of 50% tariffs on Brazilian imports to the U.S.

Such moves, while symbolic in nature, reflect the high-stakes political environment surrounding Bolsonaro’s legal predicament and its wider geopolitical implications.
