The Bangladesh Cricket Board (BCB) can now proceed with its upcoming elections as scheduled on 6 October, following a Chamber Court order suspending the High Court’s stay, according to legal experts.
On Sunday, 28 September, a Chamber Bench led by Justice Farah Mahbub of the Appellate Division extended the suspension of the High Court’s earlier stay order, effectively removing any legal obstacles to the BCB election.
Representing the state were Additional Attorney General Arshadur Rauf and Barrister Anik R. Haque. Barrister Mahin M. Rahman appeared for BCB, while Barrister Ruhul Quddus Kajol represented the petitioner.
Previously, on 22 September, the High Court had stayed the execution of a letter sent by BCB President Aminul Islam Bulbul. The letter requested nominations of councillors from district and divisional ad hoc committees.
At that time, the High Court bench, comprising Justice Md. Mojibur Rahman Mia and Justice Bishwajit Debnath, had issued a rule seeking explanation as to why the letter should not be declared illegal.
The controversy stems from a letter dated 18 September by BCB President Aminul Islam Bulbul, seeking councillor nominations from district and divisional ad hoc committees. The letter cited the amended 2024 constitution approved by the National Sports Council, stating that these nominations were required for:
Subsequently, the Cabinet Division directed that councillor nominations must comply with Articles 9.1(a) and 9.1(b) of the constitution.
With the Chamber Court’s ruling:
This development paves the way for the smooth execution of the cricket board elections, removing uncertainties that had arisen over constitutional compliance and procedural validity.
