Smoking Sales Near Schools and Hospitals to Attract Fines of Up to Tk 5,000

In a decisive move to strengthen public health protections, the government has imposed tougher restrictions on the sale of cigarettes and other tobacco products near sensitive public spaces, including educational institutions and healthcare facilities. Under a newly promulgated ordinance, anyone found selling tobacco products within a 100-metre radius of schools, hospitals, clinics, sports venues or children’s parks will face a fine of up to Tk 5,000.

The measure comes into effect following the promulgation of the Smoking and Tobacco Products Use (Control) (Amendment) Ordinance, 2025, signed by the President. The ordinance was formally issued on Tuesday night (30 December) by the Legislative and Parliamentary Affairs Division of the Ministry of Law, Justice and Parliamentary Affairs. It amends the original Smoking and Tobacco Products Use (Control) Act, 2005, further tightening regulations that have been in place for nearly two decades.

According to the ordinance, no individual or business entity is permitted to sell cigarettes or any form of tobacco product within 100 metres of the specified facilities. The restriction applies not only to direct sales but also to indirect arrangements, meaning that sellers cannot authorise or employ others to conduct sales on their behalf within the prohibited zone.

The ordinance also provides the government and local government authorities with enhanced powers. It states that, in the interest of public welfare, authorities may expand the restricted perimeter beyond 100 metres through general or special orders. This provision allows flexibility in declaring broader tobacco-free zones, particularly in densely populated urban areas where schools, hospitals and recreational spaces are located close together.

Penalties for violating the new provisions have been clearly outlined. A first-time offender may be fined up to Tk 5,000. In cases where the same offence is repeated, the punishment will be doubled, signalling a firm stance against habitual violations. Officials believe that stricter enforcement and higher penalties will deter illegal sales and contribute to reducing tobacco exposure among children, patients and the general public.

Public health experts and anti-tobacco advocates have welcomed the amendment, describing it as a timely and necessary step. They argue that easy access to cigarettes near schools and playgrounds increases the risk of smoking initiation among young people, while sales near hospitals undermine public health messaging. By reinforcing the law, the government aims to create safer, cleaner environments and gradually reduce tobacco consumption across society.
