The election is not entirely free and fair: Barrister Tania Amir

Published: 02 Feb 2026, 12:53 pm

Barrister Tania Amir has raised serious concerns over the integrity of the electoral process, warning that the current system fails to guarantee free and fair elections. Speaking on a recent televised talk show, she specifically criticised the postal ballot system introduced for expatriate voters, describing it as “a major avenue for electoral fraud.”

According to Tania Amir, the mechanism designed to allow Bangladeshis living abroad to cast their votes is being exploited in ways that undermine transparency and fairness. “Instead of facilitating an impartial democratic exercise, the entire process is being deliberately manipulated,” she stated.

She further highlighted the stance of Tarique Zia, a prominent political figure, noting that he has openly expressed opposition to holding a general vote under the current circumstances. “With such influential voices against a credible electoral process, the question of conducting a legitimate election becomes even more complex,” Amir added.

The barrister also pointed out that the government is facing challenges on two fronts. It is not only dealing with the Election Commission but is simultaneously engaged in direct confrontation with the Bangladesh Nationalist Party (BNP). “Under such a scenario, it becomes practically impossible for the BNP to participate meaningfully in elections,” she argued. She emphasised that, given the prevailing conditions, the party should consider withdrawing from the electoral contest to avoid legitimising a flawed process.

To illustrate the concerns raised, the key issues highlighted by Tania Amir can be summarised as follows:

Concern AreaDetails
Postal Ballot SystemLabeled as “a major source of fraud” for expatriate voters
Electoral FairnessClaims the entire process is being deliberately manipulated
Political StanceTarique Zia openly opposes a general vote
Government ChallengesFacing both the Election Commission and direct BNP opposition
BNP ParticipationBarrister suggests withdrawal due to lack of a fair playing field

Barrister Amir’s comments reflect a growing apprehension among political observers regarding the credibility of upcoming elections. Analysts argue that unless substantial reforms are introduced to ensure transparency, impartiality, and inclusivity, public confidence in the democratic process could be severely undermined.

The debate over the postal ballot system, in particular, has intensified as expatriate voters represent a significant constituency, whose votes could potentially influence the outcome of key races. Critics argue that any manipulation or irregularity in this process would cast a shadow over the overall legitimacy of the election results.

In conclusion, Tania Amir’s remarks underscore the urgency of revisiting electoral procedures, particularly mechanisms involving overseas voting, to restore faith in Bangladesh’s democratic institutions. The barrister’s pointed call for BNP to consider abstaining from elections highlights the broader concerns about fairness, transparency, and the ability of citizens to exercise their democratic rights without interference.
