Russia Appeals ICJ Ruling Over MH17 Crash

Russia has formally lodged an appeal with the International Court of Justice (ICJ) against a ruling that held Moscow responsible for the downing of Malaysia Airlines Flight MH17 over Ukraine in 2014, which claimed the lives of 298 people, the ICJ confirmed on Friday.

Background of the Case

  • The Netherlands and Australia, nations with the highest number of casualties in the tragedy, brought the case before the ICJ, demanding that Russia accept responsibility and pay compensation to the victims’ families.
  • On 17 July 2014, the Boeing 777, en route from Amsterdam to Kuala Lumpur, was struck by a Russian-made BUK missile over Donetsk, eastern Ukraine, where pro-Russian separatist rebels were engaged in conflict with Ukrainian forces.

Findings by International Authorities

  • The International Civil Aviation Organization (ICAO), the UN’s aviation agency, ruled in May that the case brought by the Netherlands and Australia was “well founded in fact and in law.”

Russia’s Appeal

  • On Thursday, Russia submitted its appeal to the ICJ, asserting that the ICAO had “erred in fact and in law” concerning the 1944 Chicago Convention on international aviation.
  • Moscow contended: “The Convention does not apply to situations of armed conflict.”
  • Russia also claimed that investigators ignored evidence supplied by the Russian Federation during the original investigation.

Legal Proceedings in the Netherlands

  • In 2022, a Dutch court sentenced three men to life imprisonment for their roles in the MH17 downing, including two Russian nationals.
