In a landmark decision aimed at safeguarding those at the forefront of the recent democratic transition, the Interim Government's Advisory Council has formally approved the July Warriors' Indemnity Act. The announcement was made by the Law Adviser, Professor Asif Nazrul, during a high-profile press briefing held at the Foreign Service Academy in Dhaka on Thursday, 15 January 2026. This legislative measure is designed to provide comprehensive legal immunity to individuals who participated in the mass uprising that led to the fall of the previous administration.
Professor Nazrul emphasised that the primary objective of this ordinance is to shield the "heroes of the July Revolution" from retaliatory legal actions or harassment. He assured the public that any existing criminal cases filed against protesters for their roles in the political resistance during July and August would be summarily withdrawn by the state. Furthermore, he explicitly stated that no fresh cases would be entertained regarding these events.
The Law Ministry is currently conducting a nationwide audit to identify any ongoing litigation against uprising participants. Professor Nazrul clarified that the resistance activities carried out during the movement were acts of national significance and, therefore, deserve full legal recognition and protection.
The Law Adviser countered potential criticisms by highlighting the constitutional validity of the act. He referenced Article 46 of the Bangladesh Constitution, which provides a clear framework for the enactment of indemnity laws to protect those acting in the interest of the state or during times of national upheaval.
| Legal Basis | Context/Reference |
|---|---|
| Constitutional Authority | Article 46 of the Bangladesh Constitution |
| Historical Precedent | 1971 Liberation War Veterans' Protection |
| Global Precedent | Post-Arab Spring Indemnity Laws |
| Key Objective | Immunity from retaliatory litigation |
| Scope of Application | July–August 2024 Political Resistance |
Earlier, in a social media update on 8 January, Dr Nazrul had confirmed that the draft of the 'Indemnity Ordinance' was being finalised. He argued that since these individuals risked their lives to free the nation from an autocratic system, the state bears a moral and legal obligation to ensure they are not penalised for their bravery. By granting this indemnity, the government seeks to institutionalise the legacy of the uprising and provide a secure environment for the "warriors" to contribute to the nation’s reconstruction.
Professor Nazrul further noted that such measures are internationally recognised. He drew parallels with the Arab Spring and other contemporary global revolutions, where transitional governments enacted similar laws to protect activists from the judicial machinery of ousted regimes.
The approval of this act marks a significant step in the interim government’s efforts to stabilise the domestic political landscape while honouring the sacrifices made during the summer of 2024.
