A United States federal court has officially invalidated a controversial policy implemented by US President Donald Trump that imposed a 100,000-dollar fee on new H-1B visas intended for skilled foreign workers. The ruling was handed down on Monday, 8 June, by US District Court Judge Leo Sorokin in Boston.

The court definitively ruled that the newly introduced financial charge constituted an unlawful tax that had never received the mandatory statutory approval or authorization from the United States Congress. The legal decision arises from a coordinated lawsuit filed by twenty Democratic state attorneys general against the Trump administration’s regulatory announcement made in September of the previous year, which had exponentially increased the overall financial cost associated with securing an H-1B visa.

Arguments of the Trump Administration and Judicial Reasoning

Consequently, the court ruled that neither the US Department of State nor the United States Citizenship and Immigration Services (USCIS) could legally enforce or execute the financial regulation. To support his final determination, Judge Sorokin directly referenced a precedent established by the United States Supreme Court in February of the same year, which had struck down President Trump’s executive tariff policies. The judicial order noted that the legal reasoning applied by the Supreme Court in the tariff case further confirmed that the president lacks the constitutional authority to impose taxes under the guise of executing immigration law.

Under the existing statutory framework, the United States government allocates an annual quota of 65,000 visas for skilled foreign applicants, alongside an additional 20,000 visas specifically reserved for individuals holding advanced higher education degrees. These specialized visas grant authorized foreign workers legal residency and employment rights within the country for a duration ranging between three and six years.

Prior to the Trump administration’s September regulatory intervention, corporate employers seeking to sponsor foreign professionals were typically required to pay standard administrative processing fees ranging from 2,000 to 5,000 dollars, depending on variable corporate factors.
