In a case that has ignited significant debate regarding judicial empathy and human rights, Shilpi Begum, a political activist affiliated with the Dhaka Jubo Mahila League, was granted bail late Tuesday night. The release followed an emotional day at the Dhaka Metropolitan Magistrate’s Court, where she had initially been remanded to custody alongside her six-week-old infant daughter.
Shilpi Begum was apprehended on Monday evening from the Railway Colony area of Tejkunipara. She stands accused of involvement in an attempted murder case dating back to the July anti-discrimination student movement. The victim, Tahmid Mubin Ratul, a student at the University of Dhaka, was reportedly targeted during the unrest.
On Tuesday afternoon, Sub-Inspector Sheikh Nazrul Islam of Tejgaon Police Station presented the accused before the court, seeking a detention order. The police petition alleged that Begum played an active role in suppressing student protests and argued that her continued detention was essential for the integrity of the ongoing investigation.
The proceedings took a poignant turn as the defence highlighted Begum’s precarious health and maternal responsibilities. Her legal counsel, Farzana Yasmin Rakhi, informed the court that the accused had undergone a Caesarean section at Ad-din Hospital only 46 days prior. Furthermore, Begum suffered a fractured left arm following a recent fall, rendering her physically unable to adequately care for her nursing infant without assistance.
“My child will not survive,” Begum was heard sobbing within the court corridors. “The surgical site still causes immense pain, and with a broken arm, I cannot even hold her properly to feed her. I cannot take her into a prison cell.”
Despite these pleas, Additional Chief Metropolitan Magistrate Awlad Hossain Mohammad Junaid initially rejected the bail application at 2:00 pm, ordering that the mother and child be transferred to the Kashimpur Central Jail.

The imagery of a distraught mother, nursing her child on a court staircase while being escorted by police, spread rapidly across social media platforms. The public response was swift and largely critical, with many questioning the necessity of detaining a nursing mother with a fractured limb for a non-capital offence during the investigation phase.
Responding to the mounting pressure and the humanitarian nature of the situation, Begum’s legal team filed a reconsideration petition before Chief Metropolitan Magistrate (CMM) Mostafizur Rahman later that evening.
In a rare evening session at approximately 8:00 pm, the CMM reviewed the medical records and the unique circumstances of the nursing infant. Acknowledging the physical limitations of the mother and the welfare of the child, the court granted Begum interim bail on a bond of ৳5,000.
Advocate Farzana Yasmin Rakhi confirmed that the bail remains in effect until the submission of the final police investigation report. The decision has been viewed by legal observers as a corrective measure, balancing the requirements of the state’s investigation with the fundamental rights of a mother and her newborn.
While the criminal case against her continues, the immediate humanitarian crisis was averted as Begum was allowed to return to her residence to continue her recovery and care for her daughter.
